Important Notice

WellScript Pharmacy is a licensed retail pharmacy, NOT a telemedicine service or online-only pharmacy. We do not prescribe medications. All prescription medications require a valid prescription from a licensed healthcare provider. By using our services, you agree to these Terms of Service.

1. Acceptance of Terms

By accessing our website, using our services, or submitting prescription information, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

2. Pharmacy Licensure and Scope of Practice

Licensed Pharmacy

WellScript Pharmacy is licensed by the Michigan Board of Pharmacy and operates in compliance with:

  • Michigan Public Health Code (MCL 333.17701 et seq.)
  • Michigan Pharmacy Practice Rules
  • Federal Drug Enforcement Administration (DEA) regulations
  • HIPAA Privacy and Security Rules

Michigan Residents Only

Our pharmacy services are available ONLY to Michigan residents with Michigan addresses. We do not ship medications across state lines.

Physical Pharmacy Location

We maintain a physical pharmacy location in Michigan where our licensed pharmacists practice. We are not an "online-only" pharmacy.

3. Prescription Requirements

Valid Prescription Required

All prescription medications dispensed require a valid prescription from a licensed healthcare provider. We will NOT dispense prescription medications without proper authorization.

Acceptable Prescription Methods

  • Electronic prescriptions transmitted from your healthcare provider
  • Transfer from another licensed pharmacy
  • Written prescriptions presented in person or mailed to our pharmacy
  • Faxed prescriptions from healthcare providers (where permitted by law)

Prescription Verification

Our pharmacists reserve the right to:

  • Verify all prescriptions with the prescriber
  • Refuse to fill prescriptions that appear fraudulent or inappropriate
  • Contact your healthcare provider regarding potential drug interactions or concerns
  • Require additional information before dispensing medications
  • Refuse service in accordance with Michigan pharmacy law

4. Patient Responsibilities

As a patient, you agree to:

  • Provide accurate and complete personal and medical information
  • Inform us of all medications you are currently taking (prescription, OTC, supplements)
  • Disclose all known allergies and medical conditions
  • Update your insurance and contact information promptly
  • Pay applicable copayments, deductibles, or full cost of medications
  • Comply with Michigan controlled substance laws
  • Be available to receive deliveries or arrange pickup within reasonable timeframes
  • Store medications properly and securely
  • Contact us or your healthcare provider with medication questions or concerns

5. Delivery Services

Delivery Areas

We provide free delivery to designated zip codes in Metro Detroit, Michigan. Delivery outside our standard service area may incur additional fees or may not be available.

Delivery Timeframes

Standard delivery is 24-48 hours from prescription processing. Actual delivery times may vary based on prescription verification, insurance processing, medication availability, and delivery logistics. We do not guarantee specific delivery times.

Controlled Substances

Delivery of controlled substances requires signature upon delivery and valid government-issued ID verification. You must be 18 years or older to receive controlled substance deliveries.

Delivery Refusal or Failure

If delivery cannot be completed (recipient unavailable, incorrect address, etc.), medications will be returned to our pharmacy. Redelivery may incur additional fees. Refrigerated medications may not be eligible for redelivery.

6. Payment and Insurance

Insurance Billing

We accept most major insurance plans. You are responsible for your copayment, deductible, or coinsurance as determined by your insurance plan. We will bill your insurance on your behalf, but coverage is not guaranteed.

Payment Methods

We accept cash, credit/debit cards, HSA/FSA cards, and other payment methods. Payment is due at time of delivery or pickup unless other arrangements have been made.

Insurance Rejections

If insurance rejects a claim, you will be notified and may either pay the full cash price or contact your insurance company to resolve the issue. We are not responsible for insurance coverage determinations.

7. Controlled Substances and MAPS

As required by Michigan law, we report all controlled substance prescriptions to the Michigan Automated Prescription System (MAPS). By requesting controlled substances, you consent to:

  • MAPS reporting of your controlled substance prescriptions
  • Our pharmacists reviewing your MAPS profile
  • Healthcare provider access to your MAPS data as authorized by law
  • Potential refusal to fill controlled substances based on MAPS data or professional judgment

Important: We comply with the CDC Guideline for Prescribing Opioids and may implement quantity limits, require prescriber consultation, or refuse to fill prescriptions that appear inappropriate or potentially harmful.

8. Refunds and Returns

Prescription Medications

Due to safety regulations, prescription medications generally cannot be returned once they leave the pharmacy. Refunds may be available in limited circumstances (dispensing error, etc.) at our discretion.

Controlled Substances

Controlled substances cannot be returned or refunded once dispensed, except in cases of pharmacy dispensing error.

Dispensing Errors

If you believe we dispensed the wrong medication or quantity, contact us immediately at (248) 792-7059. Do not take the medication. We will investigate and correct any errors at no charge.

9. Privacy and Confidentiality

Your health information is protected under HIPAA. Please review our Privacy Policy for detailed information about how we collect, use, and protect your information.

10. Pharmacist Consultation

Michigan law requires pharmacists to offer patient counseling. Our pharmacists are available to:

  • Answer questions about your medications
  • Explain proper use, side effects, and storage
  • Discuss drug interactions and precautions
  • Provide medication therapy management services

11. Age Restrictions

You must be:

  • 18 years or older to use our website and services (or have parental/guardian consent)
  • 18 years or older to receive controlled substance deliveries
  • A Michigan resident to receive our pharmacy services

12. Limitation of Liability

To the extent permitted by law:

  • We are not responsible for delays caused by insurance processing, prescription verification, or medication unavailability
  • We are not liable for adverse reactions or outcomes from properly dispensed medications
  • Our liability is limited to the cost of the dispensed medication in cases of dispensing errors
  • We are not responsible for third-party service failures (delivery services, insurance processors, etc.)

This limitation does not affect our professional liability for negligent pharmacy practice as defined by Michigan law.

13. Website Use

Permitted Uses

Our website is provided for informational purposes and to facilitate pharmacy services for Michigan residents.

Prohibited Uses

You may not:

  • Submit false or fraudulent prescription information
  • Attempt to obtain prescription medications without a valid prescription
  • Hack, disrupt, or compromise our website security
  • Use automated systems to access our website (bots, scrapers, etc.)
  • Violate any applicable laws or regulations

14. Termination of Service

We reserve the right to refuse service or terminate our pharmacy relationship with any patient for reasons including but not limited to:

  • Fraudulent prescription submissions
  • Threatening or abusive behavior toward staff
  • Non-payment for services
  • Suspected drug diversion or abuse
  • Violation of these Terms of Service

Upon termination, we will provide you with copies of your prescriptions or transfer them to another pharmacy as permitted by law.

15. Governing Law

These Terms of Service are governed by Michigan law. Any disputes will be resolved in the appropriate courts in Michigan. If any provision is found unenforceable, the remaining provisions remain in effect.

16. Changes to Terms

We may update these Terms of Service from time to time. Material changes will be posted on our website with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the updated terms.
